(hereinafter, “WSG“) in its capacity as owner and responsible for this website (hereinafter, the “Website”) and in compliance with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, informs users of the following information:

These particular conditions may replace, complete or, where appropriate, modify those established in this Legal Notice.

2. Conditions of access and use

By accessing and browsing the Website, the User accepts in its entirety and undertakes to comply fully with this Legal Notice, as well as any instructions or recommendations that may be indicated in each specific case through the Website.

The User is informed and accepts that access to this website does not imply, in any way, the beginning of a commercial relationship with WSG.

Access to the Website is at the sole and exclusive responsibility of the User, who shall be liable in all cases for any damages that such access may cause.

In any case, registration, access and browsing on the Website by minors under eighteen (18) years of age is prohibited, unless they have the prior and express authorisation of their parents, guardians or legal representatives, who shall be held responsible for the acts carried out by the minors in their care, in accordance with current legislation. In any case, it shall be presumed that access by a minor to the Website has been made with the prior and express authorisation of their parents, guardians or legal representatives.

In order to access certain sections of the Website it may be necessary for users to register and/or provide their personal data. When accessing these sections, Users will be duly informed of the applicable Privacy Policy so that they can expressly accept it.

The owner of the Website does not identify with the opinions expressed therein by its collaborators. The User undertakes to make appropriate and lawful use of the Website, as well as the contents and services, in accordance with the legislation applicable at all times, this Legal Notice of the Website, generally accepted morals and good customs and public order.

In particular, and by way of example only and without limitation, the User undertakes not to transmit, disseminate or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material which:

In any way that is contrary to, undermines or infringes fundamental rights and public freedoms recognised in the Constitution, in international treaties and in other applicable legislation;

Induces, incites or promotes criminal, denigratory, defamatory or violent actions or, in general, actions contrary to the law, morality, generally accepted good customs or public order;

Induces or is likely to induce an unacceptable state of anxiety or fear;

Induces or incites to engage in practices that are dangerous, risky or harmful to health and psychological balance;

It is protected by intellectual or industrial property protection legislation belonging to WSG or third parties, and the intended use has not been authorised;

Is contrary to the honour, personal and family privacy or self-image of individuals;

Constitutes any form of advertising;

Include any type of virus or program that impedes the normal functioning of the Website.

The breach of any of the above obligations by the User may lead to the adoption by WSG of appropriate measures protected by law and in the exercise of its rights and obligations, and the User’s account may be deleted or blocked, without the possibility of any compensation for damages caused, as well as the possibility of taking any legal action that WSG deems appropriate.

WSG provides Users with the following email address dpo@wsg127.com so that a User affected by any content can bring it to the attention of WSG, with the intention of rectifying said content if appropriate.

4. Intellectual and industrial property rights

The User acknowledges and accepts that the intellectual property rights of the content of the web pages, their graphic design and codes are owned by WSG or third parties and, therefore, their reproduction, distribution, public communication, transformation or any other activity that may be carried out with the contents of its web pages is prohibited, not even quoting the sources, unless with the written consent of WSG. All trade names, trademarks or distinctive signs of any kind contained in the Company’s web pages are the property of their owners and are protected by law.

Under no circumstances does access, browsing and use of the Website by the User imply any kind of waiver, transmission, licence or total or partial transfer of said rights, unless expressly established otherwise. The User has the right to use the contents and/or services of the Website within a strictly domestic context and solely for the purpose of enjoying the services provided in accordance with this Legal Notice.

The User of this Website undertakes to respect the aforementioned rights and to avoid any action that may be prejudicial to them, and WSG reserves the right to exercise any legal means or actions that may correspond to it in defence of its legitimate intellectual and industrial property rights or any other rights.

The presence of links on the web pages of WISE SECURITY GLOBAL S.L. is merely for information purposes and in no case implies a suggestion, invitation or recommendation of the same. We inform you that these links are managed by third parties, and WSG has neither the human nor the technical means to know in advance and/or control and/or approve all the information, contents, products or services provided by other platforms that can be accessed from the website.

Consequently, WSG cannot assume any type of responsibility for any aspect relating to the website to which a link may be established from the Website, specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.

5.2. Links to the WSG channel on other platforms and social networks

WSG makes available to Users, through various tools and applications, links that allow Users to access the channels and pages of the Website that it maintains on various platforms and social networks belonging to and/or managed by third parties (e.g. twitter, Linkedin, etc.). The inclusion of these links on the Website is for the sole purpose of facilitating Users’ access to these channels on the different platforms and social networks.

6. Responsibilities and warranties

WSG cannot guarantee the reliability, usefulness or accuracy of all the information and/or services and content of the Website, nor the usefulness or accuracy of the documentation made available through the Website.

WSG does not guarantee continuous access, nor the correct viewing, downloading or use of the elements and information contained on the Website, which may be prevented, hindered or interrupted by factors or circumstances beyond its control.

WSG may interrupt the service or immediately terminate the relationship with the User if it detects any use of the Website or any of the services offered on it contrary to this Legal Notice.

WSG shall not be liable for any damages, losses, claims or expenses arising from:

Improper or inappropriate abuse of WSG web pages;

Security or browsing errors caused by a malfunction of the browser or by the use of non-updated versions of the same.

Damage or harm caused, to yourself or to a third party, by any person who violates the conditions, rules and instructions set out by WSG on the Website or through the violation of the Website’s security systems;

WSG, however, declares that it has taken all necessary measures, within its possibilities and the state of the art, to ensure the functioning of the Website and to minimise system errors, both from a technical point of view and in terms of the content published on the Website.

WSG shall not be liable for causes beyond its control, including but not limited to: force majeure, Internet access problems, technological problems beyond WSG’s reasonable and diligent control, acts or omissions of third parties, etc. In all of the aforementioned cases, beyond the control and due diligence of WSG, WSG shall not be liable to compensate the User for damages, to the extent permitted by applicable law.

8. Applicable Law and Competent Jurisdiction

In general, the relationship between WSG and the Users of its telematic services, present on the website, are subject to Spanish legislation and jurisdiction.

The parties expressly waive any other jurisdiction that may correspond to them and expressly submit to the Courts and Tribunals of Getxo to resolve any controversy that may arise in the interpretation or execution of these conditions.
